Scope of Work

Express Bridge Layouts, LLC (“EBL”) provides automated geometric drafting services for straight, constant-depth beam bridges. EBL's deliverables consist of .txt script files compatible with AutoCAD and MicroStation, generated from inputs supplied by the Client. EBL does not provide engineering analysis, structural calculations, dimensioning, code-compliance review, site-condition verification, or engineer-of-record services. EBL's deliverables are not stamped or sealed engineering documents and are not suitable for construction without further engineering review and approval by a licensed engineer engaged by the Client.

Client Responsibilities

Client is solely responsible for: (i) the accuracy and completeness of all inputs supplied to EBL; (ii) verifying that EBL's deliverables match Client's design intent; (iii) adding all dimensions and engineering annotations; (iv) obtaining review, sign-off, and stamping of any plans used in construction by a licensed engineer-of-record engaged by Client; and (v) compliance with all applicable codes, standards, and jurisdictional requirements. EBL processes inputs as submitted and does not undertake to verify their engineering correctness; if the delivered output requires adjustment, Client may request a revision under EBL's revision policy.

Limitation of Liability

EBL's total cumulative liability arising out of or related to any project, regardless of the form of action (contract, tort, strict liability, or otherwise), shall not exceed the fees actually paid by Client to EBL for that specific project. In no event shall EBL be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, delay damages, or construction costs, whether or not EBL has been advised of the possibility of such damages.

No Warranty of Fitness for Construction

Deliverables are provided “as is” with respect to fitness for any particular construction purpose. Client acknowledges that the deliverables are intermediate work product intended to be reviewed, dimensioned, and stamped by Client's engineer-of-record prior to any construction use.

Independent Contractor; No Engineering Services

Nothing in this Agreement creates an engineer-client relationship between EBL and Client. EBL does not practice professional engineering on Client's behalf and is not engaged to provide engineering opinions, certifications, or stamped plans.

Payment

EBL operates on a pay-first basis. After a project is submitted, EBL issues an invoice. Deliverable files are released to Client once payment is processed.

Refund Policy

If EBL's automation produces a software-side geometric error in delivered files, EBL will correct it at no charge within 24 business hours of delivery. If a project genuinely cannot be corrected, Client receives a full refund. Errors caused by incorrect inputs, scope changes, or design preferences are handled under EBL's standard revision policy.

File Retention

Deliverables remain available in Client's dashboard until Client archives the project. Project metadata and submitted inputs are retained indefinitely for audit and record-keeping purposes.

Governing Law

This Agreement is governed by the laws of the State of Colorado.
